> One of the differences here is scent vrs pheremones. I would argue that a pheremone product would be different because it is designed to interact w receptors, and is created to do this specifically. I would bring up in court that pheremones were designed to impact people emotionally, and then just print out various forum insights. I think it would be effective enough to scare a jury, regardless of accuracy. remember,a law suit is only as good as the lawyer makes it. Easy to make this HUGE.
>
> Also, there have been lawsuits in regard to use of scents that have been fought and won specifically, in public, private and college level classes, and in elementary classes. Also, when writing up an IEP, if the child has a sensitivity it is placed in the IEP, and the teacher does not wear scent. These documents were designed as a reaction after various lawsuits have ensured the right of students to not be exposed to scents.
>
> when a student had been sensitive to scent, they have had sucessful lawsuits to order everyone in class and within certain distance to not use scent. This also has been won in regards to nuts ( not just eating them or using them in school, also the scent of them) when students were sensitive to them, and some teachers have been ordered to not use scent when a student has a sensitivity, ( college as well as public)
>
> If you consider the implications involving pheremones, and the claims that people have made in regards to them, really, why take a risk that they will start to be subjected to the court system, and regulations which may be based upon the publics understanding about them? Now that I am interested, i will do a little search to see court cases, just for fun.
>
> another thing, it is also a legal requirement that when any school has something that may be an issue such as spraying for pests, dust from woodworking, plaster dust, mold, just about anything, they have to send a release home with student , regardless of the students age or public v private school. Experiments w students in psyc classes require release. Every damn thing we do requires a release. There are good reasons for all the releases I have had to write. For many many years. To prevent lawsuits.
> I think that a disclaimer/release form is smart. in most any situation…“may I kiss you? …only if you sign this form first…😃😃”
> Finally, remember, someone does not have to win a lawsuit to crush you, they just have to sue you again and again until you spend so much money you are broke. That is the beauty of the law.😃
>
> Gonna look up some cases now for fun. BTW am not going to sue any one at all, all hypothetical.
> Any way, I disagree with you. I think it could have implications that could , with the right lawyer and judge, cause all sorts of shenanigans.

Please remember the facts when you do search for legal precedence. He said spray it at a party and see how many people then have sex.

How would you then equate the sexual escapades back to the pheromones and not alcohol? What other substances are involved? Prove that pheromones overpower a persons free will, something of course science has not been able to do. All this beyond a reasonable doubt.

Same concept of wearing Dial Magnetic to a party which has pheromones. Not going to happen.

there are several hypothetical issues involved, all “facts” ( not really considered facts as they are hypothetical)

However, when separating all of the information to examine each issue directly, what I found was that some suits have nothing to do with motive/type of pheremone/sex/free will/any of that stuff at all. look at other law suits, especially the suit about moth pheremones- I am just looking into the use of spraying scents/pheremones at all and then exposing people to them. Have several examples of lawsuits, see above, and some have been won. again see links I posted a while back to lawsuits about scent worn in public and laws involved.
remember, Law suits are expensive and time intensive, won or lost, and many were won.

1. second issue is the sex. I havent even considered that yet!😃😃 but I think that would also be interesting too.
2. third issue is consent.
3. health issues potential and imagined ( see link posted about imagined health issues, hysteria, scents banned halafax
I guess we could think of more too.

Remember this is just in fun, but if you look at links you will see that the cases are real, resuts real, ect. You say it will not happen and yet it has.

Not even close to the same thing.

1)did you read other links about scents I posted?

1. Actually as legal precedent it is golden! better than the same thing, because it is less inflammatory! and still the public cried out against it. Imagine then the public outcry that could be caused against something the public sees as sexual! remember the law is designed to look at situations that are alike in order to make judgements.
so as legal precedent I have above, and the ADA rulings as well re scent.

and what legal precedent do you have re the use of spray scents?
ah steve, powned.. ponied… my little powney ed… 🙂 come on man smile a little
if you are going to consider legal consequences, use precedents that are real cases.

or give me riesling NOW

Well we can consider this discussion when I hear back from law library, with more brain candy. I still think I should get a nice glass, but I will continue to post till I annoy you enough with facts that you give me a bottle of cyber wine in exchange for my cyberwhine or it gets to be a bore, or both.
Just wanted to show that lawsuits are a possible consequence.

Got from Law Library:

Hello carol (removed last name)Since you are located outside of Washington State, I cannot tell what specific state laws may be involved. But if they are thinking of conducting this experiment for a class-related project, they should be aware that virtually all colleges and universities have human subject or institutional review boards that require prior approval before students or faculty can engage in research or “experiments” involving other people. They should check their school’s main website for this type of committee or department. It is highly likely that their proposed experiment would require review and approval by such a board.A separate question: is the chemical included on the list “scheduled” drugs included in the Uniform Controlled Substances Act. Find your state’s laws online (you will find a good list at [http://www.llsdc.org/state-leg/](http://www.llsdc.org/state-leg/), click on the Code link for your state) and then search for the Uniform Controlled Substances Act.Depending on your state’s laws, the ages of the students in the group, how the chemical is applied or distributed, and other factors, other laws may apply. As for court cases, be aware that most court opinions that are published in print and on the Internet are from appellate courts, not trial courts. You can search for court opinions on Google Scholar, [http://scholar.google.com/](http://scholar.google.com/), and LexisOne, [http://law.lexisnexis.com/webcenters/lexisone/](http://law.lexisnexis.com/webcenters/lexisone/).I hope you find this information useful.\***Gallagher Law Library Reference OfficeUniversity of Washington School of LawQuestions? [http://lib.law.washington.edu/questions.html](http://lib.law.washington.edu/questions.html)Phone: 206-543-6794Hours: [http://lib.law.washington.edu/hours/hours.html](http://lib.law.washington.edu/hours/hours.html)Directions, Maps, Parking: [http://lib.law.washington.edu/hours/direct.html](http://lib.law.washington.edu/hours/direct.html)This information is not a substitute for legal advice.**

So we currently have:

1. The ADA act ( be careful no one is sensitive to scent at all when spraying around other people, and the only way to know for sure is consent form).
2. the idea of experiment- if it is an experiment, ( and someone can claim you are experimenting at all) smart to get a release. Because if someone objects, you can show they agreed to it.
3. consent- see above. get consent. It is different than just wearing a scent or pheremones when out in public because you have designed an experiment, so by the nature of an experiment the situation becomes something new. A consent form will protect you. An experiment is not the same thing as simply wearing a scent or pheremone. I think this would be something pointed out if there was a legal proceeding,
4. health issues- regardless of the impact upon health, unless there are studies about it, then it could be argued that pheremones are untested, and therefor something that should not be sprayed around other people, unless they consent to it. Spraying on yourself is another matter.

Really it is pretty evident that any one would be best off getting permission when spraying any scent/pheremones around other people. So hypothetically, get a consent form signed.

And that is it for now. i am tired, yawn, am going to sleep. gnite

I recommend renaming this thread to law & pheromones or creating a new one. I believe this information can be useful for some people.

As for experiment I am interested in changes on body language more than counting sex events.
