Have you guys checked out what’s in store for those of us in the US if the Food and Drug Administration Globalization Act of 2008 is passed?

There is a petition for all those opposed at [http://www.indiebusinessblog.com/indie\_bus…8/06/index.html](http://www.indiebusinessblog.com/indie_business/2008/06/index.html) If the link doesn’t work right, then just go to [The Indie Beauty Network](http://www.indiebeauty.com/) and click on her blog. It is in the section for June of this year.

For those not familiar with it, it would hit cosmetics companies hard, and if I’m understanding this correctly it will have implications for natural health as well.

You can read the full text of the draft legislation: here:[http://energycommerce.house.gov/FDAGlobalAct-08/Dingel\_60AXML.pdf](http://energycommerce.house.gov/FDAGlobalAct-08/Dingel_60AXML.pdf)

1. Require all cosmetics companies serving American consumers to register annually with the FDA, and pay a registration fee of $2,000 per facility per year, and to list in its registration the cosmetics is manufactures, processes, packs or holds, and also, for manufacturers, to list all ingredients in each product contained in the registration listing.

2. Require companies that import cosmetics to register and pay an annual fee of $10,000. Note that this would require many companies to register as importers and as manufacturers, packers, processors or holders of cosmetics, resulting in annual fees of $12,000.

3. Require all cosmetics companies to report to the FDA “serious adverse events” resulting from the use of the products.

4. Require all cosmetics companies to comply with the FDA’s Good Manufacturing Practices.

5. Require all cosmetics that import cosmetics to register annually with the FDA, and pay another registration fee to do so.

6. Give the FDA authority to levy substantial fines for violations of the new requirements.

What some may miss is that they are also including what they are calling “biological products” (herbs, vitamins, etc…not sure about pheros) in here as well. It’s listed there at the very end of the Act. I’m not sure the full implications, but seeing as how this is an act for the FDA, it seems they are finally finding ways to bring herbs and other natural products with medicinal purposes under their regulation. Would this mean we need a doctor’s perscription before we are allowed to use herbal remedies? It seems it isn’t out of the question.

The fines for violations are pretty stiff to. I don’t remember which section it was referring to, but I do remember reading fines of $100,000 per violation.

If you oppose this Act like me, then please sign the petition and contact your Senators and Congress people and ask them to stop this act.

To me it sounds like a stealth tax and protectionism for large corporations.

I can tell the tainted Chinese toothpaste was probably an inspiration for it. However, this could be potentially burdensome to alot of home/small businesses that make cosmetics, and to importers of niche cosmetics as well.

Nobody likes the idea of tainted toothpastes or cosmetics but the alternative there is to purchase from trustworthy companies, not off-brands at dollar stores.

I actually can’t find the petition on that site to sign, but I already sent the e-mail.

It’s been going on for a very long time. Companies like big pharmaceuticals are pushing the legislation to better serve their own interests. They are trying to actually regulate fruit consumption as well because of the natural vitamins.

I’m calling for revolution

If passed many, if not all, small business owners would be out of business. If you read through the proposed Act some of the fees are ridiculous. I’ve been working on a small business of my own, soap and perfume making. My plans were to launch it within the next few weeks. If this passes I can forget it, there’s no way I could cover those fees. Many of the other people I know who operate similar businesses, both local and online, would be in the same pinch.

Well as much as I’ve been looking forward to getting this going, perhaps I should hold off to see what happens here. I would hate to become distracted and loose track only to have it passed while I’m selling and getting stuck with one of those $100,000 fines. 😮 Of course since most of my recipees involve herbs and essential oils, it could be argued I was selling these for medicinal purposes which under this Act would tac on even more fines I’m sure. 🙄

Thanks for sending the email Daedelus. For anyone having trouble finding the petition, if you follow the first link it is the third topic down dated June 24. It is titled “Stop the FDA Globalization of of 2008!!”.

Fruit regulation? What will they think of next? Steveo I think I’ll join that revolution. 😉

What a coincidence. I was thinking of doing the same thing, I already know a little bit about perfumery but I could learn soapmaking, which seems to be more lucrative perhaps… melt-n-pour isn’t that hard to do, that’s my understanding. I made some homemade soap once using lanolin and some cheap shaving soap, that was as close as I’ve come (it was actually good soap for shaving or bathing, actually).

I think an oud soap or body wash could be interesting, and to my knowledge I’ve never seen one. I’d also like a good sandalwood body wash and I’ve never seen one out there except on a few websites from small-time soapmakers (Mama Bear’s and Em’s Place are two that come to mind).

this is very similar to the c-51 they are trying to get through in Canada..

in all honesty this is all leading to harmonization under codex alimentarius that is to go in effect in dec 2009.

all countries who want to trade under that time must be harmonized under codex rules. which actually relabels nutrients as toxins and must be 1/100th of the dose that actually causes an effect. this is why in france you cant get high dose vitamin C… i think 65mg (RDA.. ridiculous dumb average) is the max allowed.. and if anyone has followed the nobel prize work of linus pauling… you know you can safely ingest GRAMS of vit C a day.. in any who. i digress.

look up Codex and you will find the root of all this crap. I hope (sincerely) that the non-pharma-owned vitamin companies.. etc.. will actually put up a good fight..

there is a good google video on it.. ummm natural solution foundations..Dr. Laibow..

i will see if I can find it.

It’s crazy enough that anyone would even have a notion such as this, let alone actually try to push the point on people. 🙄

Well perhaps it isn’t too surprising considering all the real toxins they pump into the food they produce and then try to convince us we’re eating healthy.

Hey Queenie-T, I just watched that video you linked to. I actually hadn’t heard of Codex before. All I can say is, wow. . . This is definitely something I will be keeping my eyes on. Thanks for posting about this.

Some trade harmonization is good. Just an example: for many years many Japanese and European scooters could not be sold widely in the US because the rear brake was actuated with a hand lever, whereas US law did not have a classification for “motor scooter” at all, treating them as motorcycles. Under US codes, motorcycles above 80cc’s all had to have rear brake pedals on the right side of the motorcycle, or they were not roadworthy. Finally the NHTSA (National Highway Transportation Safety Administration), just last year, decided that they would premanently waive the regulations, because there was no evidence that hand brakes were less safe than pedal brakes.

Before this, they had been allowing in only a limited number of motor scooters and they had to get waivers for every model. Also, Chinese companies operated completely illegally bringing in 125-250cc scooters that were not in compliance (a dirty secret but many turn signals on Chinese scooters are still not in compliance, also all motorcycles/scooters in the US must have daytime running light headlights- not all Chinese scooters have these) but nobody was slapping any of them with fines, and yet the Japanese were playing by the rules and facing unfair competition.
