I went to buy some food today in North Miami and this guy gave me what I would call a “love tap”. Literally no structural damage was taken by my car but the Plastic covering of the light on the passenger side cracked some. I was in the middle lane and I heard a a honk of the horn somewhat in the distance and this dude in the right lane just body slammed into my passenger side to the point where I went into the left lane. Luckily there was noone in my or near my blind spot so I didnt collide with anyone else. The guy stopped on the side as I went by and my friend who was sitting in the passenger side checked for damage by opening the window and looking and for the most part there was nothing. Later when we got to the place we looked it over and obviously there was some of his paint on my car but really minor at best. It was only later I realized that the light covering cracked some and the door would “creak” when I opened it. Its mainly because the plastic covering right after the door was pressed in some. I didnt go back to file because I didnt think there was anything to file. I’m looking back at myself stupidly atm because I realize that this guy couldve gotten my tag and pinned it on me as a “hit and run” even though it was me who was hit and me who ran. I’m just wondering if anyone is familiar with procedural measures with this sort of thing and give me an idea of what to do. I dunno if I should still report this to my insurance company or not. At this point I dont care about punishment or anything I just dont want to be implicated for damaging his/her car when it was they themselves that damaged their car when they hit mine. I’m more worried about this dude coming after me than anything else. My mother is very pissed with me at the moment and shes actually what I’m more concerned with because Im no claims adjuster but it just doesnt seem like there would be any money. I KNOW I SHOULD ALWAYS FILE except I ALWAYS try to avoid conflict so I’m here with this predicament. ---

((((Olfact)))) Oddly my husband just did sort of the same thing yesterday. He was rear ended in his work truck but got out and talked to the girl. She was on her phone when it happened. He was in a hurry and there was little if no damage to his truck. Her car had a broken light and some denting though. He let her go but did exchange info with her. I was upset with him when he told me for the very same reason your worried. What if she turns around and says you hit her. Always report an accident because unfortunately people are not all honest and nice. My husband is not going to report it only because he is not going to claim anything. The girl said she didnt care about her damage but like your situation she may reevaluated that thought later and try to claim with her insurance in which case we will probably have to file a report and pay a fine as well as deal with messy insurance issues. Nothing I can do about it now so no sense in worrying about it. He will have to deal with it if she decided to file a complaint. As far as insurance… Do you have no fault coverage on your insurance ? I think in Florida your no fault is only good if the police were contacted and a citation was issued. In CT you can just make a claim and your insurance will cover it. If this is the case in Florida then your right you wont get anything for the damage. Not because its not worth anything but because you didnt report it to police and cant tell them who hit you. From what your saying about the light and the door you have over $1000 in damage. No frame damage but probably damage to the area where the door connects to the car which is why its making noise. Damage is not always visual. Look at your policy and they should have an explanation of no fault in Florida for you. They probably have it on there website as well if your insurance company has one. If you bought the insurance from a insurance agent and not directly from the company call them and they will give you advice as well before you file a claim. As for the guy coming after you… I am going to be blunt and honest here. He probably already called the police to report it. If he didnt get your plate you may be OK. If he did you will know within 48 hours as the police will show up. You probably will have some issues to deal with because you didnt stop. It was a hit and run. He stopped, you didnt and it matters little which one was at fault. Because you kept going it is going to be harder for either of you to prove who was at fault, however your leaving the scene without stopping is not going to make it look good in your favor. The police will ask if you were not at fault why didnt you stop ? If it were me I would face the music and go down and report it. There will be repercussions though. You can sit around and worry yourself sick and imagine what may happen and when it will happne or just face the issue head on and get it over with. In your attempt to avoid conflict you created much more conflict which is usually always the case with conflict. Life is full of conflict, its unavoidable. However you get to choose if its good or bad conflict by your actions. We all make mistakes in judgement once in a while. My advice… go down and report it and take responsibility for your actions then ask your self what you have learned from this whole mess. Tisha
