I have a delicate matter that I have some questions about. It’s a criminal matter, I’ve written about it to some extent in my journal, but I was hoping an attorney would be able to shed some more light on my legal situation.

I’m trying to find out how I might be able to make this case stick and what I can do to protect myself from any charges they might make against me.

The problem is that I mostly only have names, no contact numbers, witnesses, or evidence, for that matter. Just a lot of shoe marks and cuts and lumps.

_ **I will not hold anyone responsible for the suggestions or advice that they provide.** _

Please advise. Thank you.

hi phya

i have just read up on your situation in your journal, and first of all, what a bunch of immature cunts but im glad your ok.

i dont have any experience of american law so i wont go into massive detail but in england there would be a very high chance of conviction.

first of all criminal damage for the car and the property, if a weapon was used it is aggravated criminal damage. burglary, theft is not strictly required for there to be a burglary but there needs to be an intent to theft or cause grevious bodily harm and as soon as any part of the body enters the property as a trespasser the offence is commited. you would need to show that they intended to cause you harm or were reckless as to causing you some harm, as a weapon was used it is an aggravated offence. in england if you cause an injury that breaks both layers of skin, bleeds or is deemed to be serious harm and you intend to cause wounding or grevious bodily harm, then it is s18 offence, this is the most serious offence against the person other than murder/manslaughter.

i appreciate the law in america is different to england so i wont write an esaay on it but the most important thing is to collect evidence of all your injuries and damage suffered, write down as much as you can remember and report it to the police as soon as you can, let them do the work it is their job.

good luck and i hope you fuck up their frat party good style.

in\_uk Close! Do you want a job?😉 don’t forget s20 " inflict GBH _with intent to endanger life",_ just one step from attempted murder, you would also get the burglary under s9(1(a)) if you could prove that they entered with intent to cause criminal damage

Phya, you really need professional advice from someone registered with your State Bar Association, in\_uk and I can speculate all we like, if you were in the UK, I count at least 5 criminal offences, all imprisonable, but your laws are different and we may just confuse the issue for you. If finance is an issue, try asking if any lawyers do civil actions (as opposed to criminal) on a no win no fee agreement, it is also normally easier to prove civil as opposed to criminal offences. You mentioned that the frat prats weren’t directly involved but got outside “help”, they are still guilty, just as the woman who hires a hitman to get rid of her husband will still do serious time!

in\_uk
Sorry, probably caused some confusion there! Have been speaking to Phya via PM and police are somewhat unwilling to act, hence the suggestion for civil litigation. You seem well informed, I take it you are in the same game as me?

Ah, the dark side! Started as a copper, then Legal Exec and glad I didn’t have to do LPC/BVC and training contracts. Any idea where you want to specialise?

Ah, the dark side, with LPC and training contract still to come, I envy you not one bit! I did it the easy way, copper, legal exec, no training contract and earn the same money. Perhaps we should set up a practice together in a few years and pump TUTH through the aircon??

Sorry for the hijack Phya!

a bucket of instant honesty in the dock should do it, but make sure you pass the cost on to the client. maybe start a thread A314 in the courtroom.

anyway the darkside is looming as i have got an exam on monday, so i am dragging myself away from the [pheromone](https://a314.com/) world until monday night.

laters and good luck pyha.

No worries at all about the hijack, I’d rather my threads bring people together than not at all. 🙂

Thanks for the advice, I’ll take it all into consideration. I’ll come out of this better, one way or another. 😉

I skimmed your journal, and wondered, did you call the police and file a report?

I would suggest calling the District attorney or a local attorney and see if they can give you some advice about pressing charges. (not that you are wanting to or have enough information to but you have it on file if you need the information later. (likely you will be talking to a paralegal but it is still someone who can notarize their notes)

As for protecting yourself, there is a reason they called Louisville Sluggers “Frat Bats” when I was in college. keep them handy and be ready to pick up and start swinging and hitting home runs.
my other suggestion would be a low light video camera, so you can film them. Sony night shots are only a about $150-$200. But then you can also get a home security system with 4 cameras for about $200 that records to a computer or long play digital storage.
Video shows you are only trying to defend yourself and your property.

(I have 4 lawyers in the family, I bounced most of your story off my cousin to see what he thinks, if he replies it will be a few days)

Lol, frat bats? Never heard of that before, but I like it. 😃

What happens though, when that frat shows up with frat bats of their own? I had a 5lb lacrosse stick that’s guaranteed to break bones but I didn’t swing because they would eventually have taken the weapon from me. A mob is hard to take down by yourself, without projectiles…

I dunno, I live my life through peaceful means precisely because I don’t want to have to ask these questions..but I suppose some of it is inevitable.

I have file a report already, but they want to hand it off to campus police. We’ll see what happens when they call back to follow up.

I appreciate you asking your family (a family I wouldn’t dare try to take legal action against 😉) about my situation. Thanks Woofie.
