Mmm…in a Public University system maybe - you get into civil rights violations when you start applying that to Private universities.

here’s an interesting article that discusses some of the issues at hand from the NYT in 2003 - note they are speaking specifically of University policies - not laws:

[Universities Tighten Rules on Faculty-Student Relationships](http://www.nytimes.com/2003/09/30/national/30CND-ROMA.html?pagewanted=1&ei=5007&en=f736e0940c2deb9f&ex=1380340800&partner=USERLAND)

if the law has changed since 2003 and sleeping with consensual age students in a University setting is now illegal, then i stand corrected, but I can’t imagine a law like that passing, because of the civil liberties issues at stake (and i do find those issues valid, regardless of whether they are ethically correct).

With a public high school - i can sort of see it, because students are still looked upon as wards of the state whilst they are in school, regardless of age.

university settings have **zero** to do with texas and connecticut.
nothing i have pulled up states it only applies to highschool.
they make general “educational authority” titles.
one law passed i believe in 2001, the other 2004. i may be incorrect about the exact year.
and those are the ones i know of.
there are numerous court cases that can be pulled up that throw in there something to this effect:

> [@](#):
>
> Attorney General Richard Blumenthal, representing the state before the Supreme Court, disagreed, saying students cannot give genuine consent because a teacher is in a position of power and authority over the student.
>
> In their ruling Tuesday, the justices said, “In light of the disparity of power inherent in the teacher-student relationship, we conclude that both victims were situated in an inherently coercive relationship with the defendant wherein consent might not easily be refused.”

im not posting about school/university policies. im talking laws concerning age and positions of authority. i have also seen articles because of the latest news blow-up about this very issue, that many states now are trying to change the law now. one stated 2006, but i dont know what ever came of that.

Wow, what conroversy. 😮 😛

As far as I could find there is no law for student teacher relations at a university in Indiana. There is a law regarding highschool setting (which is good)

I am at IPFW which is an Indiana and Purdue affiliate.

I could not find any policies relating to student teacher relations at IPFW.
Here is the link [IPFW: University Policies](http://www.ipfw.edu/academics/regulations/policies/)

This is out of the Purdue University Policies, and I assume something along these lines would apply.
[Purdue University :: University Policies :: Safety : A-16](http://www.purdue.edu/policies/pages/human_resources/c_33_print.html)

> Amorous relationships that occur in the context of educational or employment supervision and evaluation present serious concerns about the validity of consent. The disparity of power between persons involved in amorous relationships of a teacher and student, supervisor and subordinate, or senior and junior colleagues in the same department or unit makes them susceptible to exploitation. Those who abuse their power in such a context violate their duty to the University community.
> Relationships between faculty and students are particularly susceptible to exploitation. The respect and trust accorded a member of the faculty by a student, as well as the power exercised by faculty in giving grades or recommendations for future study and employment, make voluntary consent by the student suspect. Anyone who engages in a sexual relationship with a person over whom he or she has any power or authority within the University structure must understand that the validity of the consent can and may be questioned. In the event of a charge of sexual harassment, the University will give very critical scrutiny to any defense based upon consent when the facts establish that a power differential existed within the relationship.

This next section is from Indiana Universities Polices.

I understand it’s unethical, and if I was a professor I wouldn’t even consider such actions.

You must remeber that I’m in Indiana. People get very touchy about what freedoms are taken away from them (even by policies in the workplace that are benificial.)

I’m a tenured full professor. It is against our university policy to have intimate relations with students. However it happens all the time and rarely does anyone complain. Why? These are consentual relationships between adults. It’s not the same thing as sexual harassment where you have repeated unwelcome advances. The single sexual harassment complain in our department involved a female dance instructor that was touchy feely with female dance students. Nevertheless it is almost impossible to get fired as the grievance committee must prove beyond a reasonable doubt the professor did wrong. And the evidence is usually the student’s word against the professor. Also, it is not uncommon for students to file false claims as revenge. The few cases that have come up resulted in a light slap on the wrist. I should also mention our faculty union is well placed, well financed and ready to endure extensive legal battle if need be. The grievance process is spelled out in our contract. No adminstrator has the power to fire a faculty member without first going through the grievance process and proving their guilt beyond reasonable doubt. Our union also provides legal support for civil lawsuits. However, if you’re an untenured trouble maker you could find your contract unrenewed for reasons of “performance.”

Most of the time the students come on to the profs and we gently bounce them out the door. We try to keep things professional and, really, most students are not that attractive. I can’t say how many females students have come on to me as it happens so often. Many are extremely blunt and aggressive. I’ve even been stalked and my ex-wife was threatened. However sooner or later you meet someone really special and things happen. After all, you share a strong common interest and often work closely. About half the professors in my department are married to former students. I was married to a former student for nearly 20 years. My department chair is married to his former student and the choir professor, a woman, was married to 2 of her former students. Our piano prof, a woman, was married to her former prof.

Incidentally, if a professor told his or her class he or she was horny, nobody would give a damn here. I’d never say it. Of course, I’ve never been exposed to an attractive woman moned up with Essence of Woman. Perhaps you lose 50 IQ points, all good judgement and are like moth to a flame…

then we are discussing two different things Lor. I’m specifically talking about universities and university policies.

you are talking about age of consent. and whether it’s legal in student teacher relationships. I don’t argue that point.

what I am arguing is what is defined as a student/teacher relationship.

for Public Education systems, it is one thing. But those same laws, no matter what State we are talking about, don’t apply to Universities, because Universities do not fall under the State Board of Education, or Public School System.

this being said, I’m tired of going around in circles, because it’s like arguing in 2 mutually exclusive languages. You say something in Korean, I reply in Hungarian, and we’re just not understanding each other.

Lor, you are not to far off. They are Federaly funded, which means they have to follow some regulations that private schools may not have, but they are not under complete control like a public school (high school) which is funded almost entirely from the government.

You still have to be accepted and pay tution, so they can’t be “public”
