The cops think I smell like marijuana

so I wore 2 sprays of instant gentlemen in my hair tonight to go eat with my college group. didn’t notice anything out of the ordinary there. driving home i forgot to turn on my lights when i started my car because there were lights in the parking lot. I drove a block down the street before remembering to turn them on. so a cop decides I am high and pulls me over and tells me i smell like marijuana. and of course it doesn’t help that i emotionally shutdown under pressure now he really thinks im on drugs. ive never smoked anything in my life. this has happened to me once before when wearing pheromones. do pheromones smell like marijuana?

some of them smell like patchouli which is the incense that alot of weed heads use to cover the smell of weed. The cop might have mistaken that smell for weed…

And alot of times they use the smell of weed as an excuse to search you… they only need reasonable suspicion that something illegal is going on to search your car. So he was probably trying to justify his search of your vehicle if it came to that. He might not have searched your car but I bet he was thinking about it and hence the “you smell like weed” comment.. Its very hard to prove that you didnt smell like it as no one can verify this and in court it will be you v. him and juries tend to believe cops as well as magistrate judges at gerstein hearings when they determine if there was probable cause/reas. suspision after you are arrested.

Sux that you got pulled over but thats just a product of the police state we now live in… Welcome to the home of the free.

wait I did notice something out of the ordinary. The girls on my end of the table made 3 jokes in a row about topics having to do with sex and this was a church group. not that that has anything to do with being pulled over

yeah he searched my car. he asked first. I let him because i dont got anything to hide and i didn’t want to get on his bad side. I couldn’t find my insurance papers though. now ive got a court date when im susposed to be in class. its all good though im failing anyway not much i can do about it at this point.

The cop either was trying to intimidate you or was on crack. Androsterone smells like mild BO. And, unless you were soaked in rone, it is extremely unlikely he smelled it unless he had you in a choke hold…

Spaceland sometimes reminds people of weed as the clary sage EO is oft used in hippie incense used to cover it.

yea it sounds like he wanted to cover his ass and ask for your consent to search, and in the event that you refused he would rely on the fact that he smelled weed and had reasonable suspicion to search anyway. He may have let you go though because he wouldnt want others to find out he didnt actually smell the weed. You must have looked vulnerable to him.

Sorry I cant help analyzing legal issues.. im in law school lol.

So you have a court date for the ticket he gave you for your light? Or did they cite you for something else?

Always remember, if you are stopped and the cop has no reason to be suspicious of you for anything but a traffic violation, they cant search your car. They will ask you “im gonna go ahead and look around alright?” and as soon as you say yes, then they have your consent and search your entire vehicle. Now, you have the right to say no in that circumstance. Most people say ok because they think they have no choice. Notice the language he they use “im gonna go ahead and look around alright?” See what I mean.. it makes you feel like they are gonna do it anyway, and most people say, ok, just not even thinking about it.

Cops can only hold you long enough to do what they stopped you for… so if you say no, and they have no suspicion of anything else, then they cant hold you to get a warrant. They cant even hold you to get dogs if they dont have suspicion.. any holding of that sort would be considered an arrest, depriving of your liberty to move around. And under our constitution they cannot do that. The longer they keep you for a traffic stop without suspicion of anything else, the more in violation they will be.

See how he screwed you? Let me guess, you live in a college town and were within 10 minutes of campus… right?

Seems like the cops around campuses are douches like that and really abuse their power knowing that some kid isnt gonna know their rights and will consent to everything and not contest it cause they are too afraid. Remeber they are suppose to be serving you not you serving them. Make them follow the constitution and require them to show you reasonable suspicion and dont consent to searches anymore unless they can articulate a reasonable suspicion. If you would have said no to the search he would have let you go right there.. maybe with a ticket but he sure as hell doesnt want others involved because they might find out he lied about you smelling like weed.

The court date is for not having his insurance card. As soon he shows proof of insurance they’ll dismiss charges. The cop was a douche and was really reaching and got squat. So to look like he was just doing his job he wastes tax payer resources sending this kid to court to show proof of insurance. They should dock the cop’s pay for the time and resources wasted. Plenty of real criminals out there if he’s actually interested in doing something useful.

Never give consent!

This video may be one of the most important pieces of legal education w/r/t fourth and fifth amendment protections you will ever watch, delivered by an established expert in the field… ignore at your peril… in this orwellian day and age that peril may be significant: :open_mouth:  :open_mouth:

I bet you its because of the neroli cover scent. A lot of people use “fruity” scents to cover the smell of weed. usually the smell dries down pretty quickly, but if he did smell it on you he might have thought you were using something to get rid of the weed smell.

Also never consent no matter the situation. He could find the smallest thing you wouldn’t think of to screw you over if he wants to.

The most important thing is not to offer any information unless it is directly demanded of you. The use of the formal term “Sir” will get you out of more difficulties than any smart comeback known to man.

Answer very simply. Ask very simple questions. If he/she/they say, “we’re going to look around if that’s OK”… you may simply request clarification.

“if you don’t mind I’d like to ask a clarifying question, sir”.
or…
'I need to ask a clarifying question, sir".

any number of possible responses may follow… whatever…

“are you requesting permission to search this vehicle , sir” ?

yes/no… or incoherent response, such as “we’d like to look around”

“did anything you observed meet the standards of probable cause, sir” ?

Obviously this takes a lot of confidence to pull off convincingly. When I was a lot younger we drove in and out of the south texas-mexico border zone on the US side… it was standard procedure to damn near disassemble every vehicle as it got about 50 miles inbound on the texas side… they ran background checks against the ID of every passenger, you has to empty out or unfold everything… they had double teams with itchy trigger fingers… so you got very familiar with the routine…

  1. move and speak slowly… almost comically slowly w/o looking like an idiot… you could get these spring clamp things that attached to the dashboard that would hold all of your papers… the feds appreciated that,
NO sudden reaching for the glove compartment…

  2. if instructed, cooperate quickly and efficiently as if you enjoy taking orders… (while maintaining unconcerned mellowness)

  3. keep the interior well vacuumed, don’t stuff crap behind your seat, don’t have any old snack food bags, cola bottles, donut cartons or anything like that…cops think that’s a tell for dopers and degenerates

  4. absolutely do not hang anything from your rearview mirror… especially plastic skulls or weird goth junk

  5. keep the ashtrays clean and closed…

  6. don’t volunteer any information… give simple, minimal answers, they often use long silences to see if they can shake loose any free floating thoughts… if they’re silent, you stay silent, and if they instruct you to stand in one place, clasp you hands in front of you and stand absolutely still and await instructions… never, ever, ever reach for your pockets, esp your back pocket…no, no, no, tacitus almost got shot dead putting his hand in his pocket… if you need to extract something from a pocket,
explain in advance…“I need to reach into my back pocket to remove my wallet”… let THEM tell you how they want you to get it out…

BEEN THERE, DONE THAT

Excellent advice! You’d be amazed how much people blurt stuff out during those awkward silences.

Another tip … try not to laugh at the end of sentences. People do this to break the tension but it makes you seem guilty as hell even if you aren’t.

Example:

Cop: “Got any drugs on you?”
Guy: “Ummm, no … tee hee hee hee”

sorry I haven’t been on the site in awhile. I gave proof of insurance and now I don’t have to go to court. yes I live in a college town and im sure there are lots of people in my town that smoke weed. I heard of someone in my nieghborhood getting arrested for growing pot in their basement. but suspecting someone is on drugs because they forgot to turn their headlights on? next time I pass the cops they are getting brights in their face. thats what you get.

I believe that citation is called “failing to dim headlights to oncoming traffic.”

lmfaooo. Its gonna suck if you blind em and they veer off the road and you get blamed.

I did move and speak slowly, but they got suspicious of that too.
