I have a court date on Monday, Nov 16, in which I was clocked doing 82 (mandatory court) in a 70. I had my cruise control set on 79. Still … when the trooper came to my window, he said, “I clocked you doing 82.” I said, “I had my cruise control set on 80.” He got loud and said, “WELL! YOU’RE GETTING A TICKET FOR 82!”
This has happened to me once before. I got pulled and the trooper said I was doing 65 in 55, but my mom was in the car and screamed, “No he wasn’t! He was doing 60!” I told her to chill out, and he gave me a warning instead, because I had a witness. I say.
Anyway, I figured I got the “This is going to look good in my records” again, because I was polite and gave him no reason to get nasty.
Anyway, I have about 5 trooper friends in my area, and I asked why the trooper was determined to tack on two more miles. They said because it’s a MANDATORY COURT appearance. Still … they told me to see if I can find a speedometer calibration place, and get it checked.
I found one, and it was 3 miles over. I got the documentation that states so. They (my trooper friends) said it MIGHT help, come Monday.
I wanna do 4 drops of A314, 4 shots of IS, and about 100 mcgs of EST … not Meo-Est. Hoping that I’ll end up just paying court cost, and not having to pay extra bucks for a lawyer. What do you think?
Ouch! I know how you feel… sort of. I got nabbed recently for doing (significantly) over double the speed limit within city limits, and got a very nasty ticket for it. Except that was all my doing…
I’d say you’ve got a decently good shot at winning your case, or at least getting a significant reduction. The counter-argument is that you’ve already been pulled over and never got your speedo checked, so that’s sort of your fault. At the same time, speedometers are usually tuned to a +/- 3% (or less) variance, with motivation given to make it overly optimistic (thus travelling slower than reported by the dial). I remember hearing about some VW Golfs being somewhere near 10% optimistic at one point prompting a recall…
Just go in there, be honest, respectful, and good luck!
trooper nabbed me on my way out of washington state with my cruise on 80 said i was doing 81 $162 ticket on a class a cdl.. didnt say i needed to go to court.. just paid it and heard nothing else
Here, 81 and below in a 70 is a ticket as well … 82 is mandatory court appearance. Had he given me a ticket for 80, I’d just pay a ticket, too.
It’s the quota thing that has troopers doing this. It’s the second time this has happened to me. I was doing 60 (cruise control) in a 55, and a trooper pulled me, said I was doing 65. I had my mom in the car, and she screamed out, “No he wasn’t!” I guess he figured against his intentions, and gave me a warning. They do that to people. It’s their word against yours! I’m a witness!!!
Still, 1 mile over the speed limit, is speeding, so …
Always remember to ask for the calibration record ON HIS RADAR GUN - Cops tend to be lazy/cheap about getting their guns recalibrated regularly
I’ve gotten out of so many tickets by just asking for the calibration on this radar gun when I’m pulled over - 90% of the time the gun is past its calibration date and the guy lets (slinks off) me off with a warning.
EDIT: Calibration for those guns is EXPENSIVE… you will see uncalibrated guns in smaller counties almost 100% of the time
I know when I go to court they always plea bargain down and usually get it to no points and just have to pay a fine, unless you have a lot of points already or license is suspended they will do this for you.
For the most part these traffic courts are a cash cow for them and not much you can do to get out of it, hiring a lawyer will cost you a lot more and not worth it unless you are facing jail time or losing a license or something like that.
i think mostly the reason he didnt give me more was because i had florida tag and was on my way out of state.. so i woulda missed their gay court apperance
I would request a calibration report for the Speed device used to capture and record your speed. because if your speedometer is that far off you need it fixed, it is illegal for a speedometer to read slower than you are actually going, which is why most read about 3% low.
depending on your jurisdiction or and judge, you can sometimes get the fine reduced from speeding to a non-moving violation such as “parking in a handicapped spot without identification”
Anything over 80 mph or 15 mph over the speed limit in N.C. is considered reckless driving. After two of those I lost my license there back in 1996. Luckily I was just stationed in California at the time and was able to switch licenses. The CA DMV laughed and said if the CA laws were as strict as NC no one would be driving on the west coast. Unfortunately I lost those too. I later went through law enforcement training and learned how to get out of most tickets. Got otta DUI once after blowing a .17. LOL. My advice is to get a lawyer cause your insurance will probably go up no matter what. Better to bet the bank and get it thrown out. Don’t wear any couplins just in case they throw you in the slammer. J/K. Good luck on it.
Sorry, but I’m throwing myself to the mercy of the DA. Should my best interest not be in his plans, I’m going to ask for a contingency, and get a lawyer.
My mone wear will be 3 drops of A314 and 2 sprays IS X4. :o
I got in there, freaked out, and asked for/filled out a form for a court-appointed attorney, thanks fer asking, MJ! When she finally called my name, she said, “We don’t give court appointed attorneys for speeding tickets. We’ll give you time to get one … 5 February 2010.”
I was supposed to have asked for a faulty equipment plea. I remembered the moment I got in my truck!!! :o I said to myself, “Self, screw this! Let a lawyer take care of it! It’s only gonna cost you 320 bucks!”
